Information we collect and why
When you contact us, we may collect your name, email address, company details, and any information or materials you share about your project. We use this information to respond, prepare proposals, and manage our working relationship.
We process this information to take steps towards an agreement or fulfil an existing agreement. For enquiries made on behalf of a business, we may also rely on our legitimate interest in communicating with prospective clients and managing business relationships.
If you become a client, we process the information needed for contracts, invoicing, project delivery, and record keeping. This processing is necessary to perform our agreement and meet legal obligations.
Our website is hosted by Squarespace. When you visit, technical information such as your IP address, browser, device information, and pages visited may be processed to deliver and secure the website. We rely on our legitimate interest in maintaining a functioning, secure website. Optional analytics or marketing technologies are used with your consent where required.
Providing information is generally voluntary, but we may be unable to respond or deliver a project without the relevant contact and project details.
Cookies and your choices
This website is hosted by Squarespace. Necessary cookies support website functionality, security, and the storage of your cookie preferences.
Where consent is required, optional cookies are only activated after you agree. You can accept or reject these cookies through our cookie banner and change or withdraw your consent at any time using the cookie preferences control at the bottom of the website. Withdrawing consent does not affect processing carried out lawfully before withdrawal.
If you accept analytics cookies, Squarespace uses them to help us understand visitor numbers, browsing sessions, and how people find and use the website.
Squarespace cookies that may be used include:
ss_cid, ss_cpvisit and ss_cvr: distinguish visitors and connect browsing sessions. Duration: 2 years.
ss_cvisit and ss_cvt: measure browsing sessions. Duration: 30 minutes.
ss_performancecookiesAllowed and ss_marketingcookiesAllowed: remember your cookie consent choices. Duration: 30 days.
You can also delete or block cookies through your browser settings. Blocking necessary cookies may affect website functionality.
Project materials and AI tools
Our creative process may involve third-party AI generation, editing, and production tools. Materials submitted for a project may be processed through these services where necessary for the agreed work.
Where materials contain personal information, we establish the appropriate legal basis, permissions, and safeguards before using them. Depending on the project, we may act as an independent controller or process information on a client’s instructions under a separate data processing agreement.
Please discuss confidential materials, photographs of identifiable people, and other personal information with us before sending them. Permission to use a photograph does not automatically include permission to upload it to an AI service.
Our AI image work primarily involves fictional people and real or fictional products, rather than personal information about identifiable individuals. If a project requires personal information to be processed through an AI service, we will provide information about the relevant providers, purposes, retention, and model-training arrangements before processing begins, where required.
Who receives information
Where necessary, we share personal information with service providers supporting our business, including Squarespace for website hosting, email providers for correspondence, cloud storage providers for project files, and accounting providers for invoicing and financial administration.
Information may also be shared with professional advisers or public authorities where necessary to meet legal obligations or establish, exercise, or defend legal claims.
We do not sell personal information.
International transfers
Some providers may process information outside the European Economic Area, including in the United States. Where this happens, we use a legally recognised transfer mechanism, such as an applicable adequacy decision or Standard Contractual Clauses, together with additional safeguards where required.
You can contact us for information about the safeguards relevant to your data and how to obtain a copy.
How long we keep information
We keep personal information only for as long as needed for the purpose for which it was collected, including applicable legal and record-keeping obligations.
Our retention periods are:
Enquiries that do not become projects: up to 12 months after our last contact.
Client correspondence and project materials containing personal information: up to 2 years after project completion, unless a different retention period is agreed or the information forms part of records we must retain by law.
Accounting and tax records: generally 7 years, or longer where legally required.
Cookies: the durations listed in the “Cookies and your choices” section apply.
Website analytics and logs: where enabled, Squarespace’s Activity Log makes individual visit details available to us for 7 days. Aggregate traffic statistics may remain available for longer to help us understand website usage over time. Squarespace may separately retain technical and security logs under its own data-retention policies.
Records may be retained longer where necessary to meet a legal obligation or establish, exercise, or defend legal claims.
Security
We use appropriate technical and organisational measures to protect personal information, including access restrictions and security measures suited to the services we use.
Your rights
Depending on the circumstances, you can request access to, correction of, or deletion of your personal information. You may also have rights to restrict processing, object to processing based on legitimate interests, and receive or transfer your information.
Where we rely on consent, you can withdraw it at any time. Withdrawal does not affect processing carried out lawfully beforehand.
Contact contact@studiopoiesis.ai to exercise your rights. We normally respond within one month; where a lawful extension is necessary, we will explain why.
You can also lodge a complaint with the Dutch supervisory authority, the Autoriteit Persoonsgegevens.
We do not use personal information to make solely automated decisions that produce legal or similarly significant effects on you.
Website Terms
AI-created imagery
Studio Poiesis creates visuals using human creative direction, generative AI, and digital editing. Unless stated otherwise, portfolio imagery may be wholly or partly AI-generated or digitally manipulated.
People, settings, products, and events shown may be fictional, altered, or composited. Images should not be treated as documentary evidence, product-performance claims, or proof that a depicted event occurred.
Where additional AI disclosures are required for particular work or its publication, those disclosures will accompany the relevant content.
Portfolio and concept work
The portfolio may include commissioned projects, independent experiments, and speculative concepts.
Work identified as a concept or independent exploration does not imply a commission, collaboration, approval, or endorsement by any featured brand. Third-party names, trademarks, and materials remain subject to their respective owners’ rights.
Using content from this website
You may browse the website and share links to its pages.
Except where permitted by law or expressly authorised, you may not reproduce, redistribute, sell, commercially exploit, or use our portfolio materials in advertising without prior written permission. We do not authorise their use in AI training or datasets without a separate written agreement, subject to applicable law.
Rights in the website’s original text, design, and protectable creative contributions are reserved by Studio Poiesis or the relevant rights holders. AI-generated elements may have different or limited intellectual property protection; we do not claim exclusive rights where those rights do not legally exist.
Client projects and usage rights
These website terms do not replace a project agreement. Scope, fees, timelines, revisions, confidentiality, deliverables, and usage rights are agreed separately in writing.
Displaying work on this website does not grant a licence to use it. Commissioning a project does not automatically transfer every intellectual property right or include working files, prompts, unused concepts, or production methods.
Any licence or transfer will be described in the project agreement. Because generative AI can produce similar outputs for different users, absolute uniqueness, exclusivity, and copyright protection cannot be guaranteed for every AI-generated element.
Materials supplied by clients
Clients must have the rights, permissions, and lawful basis needed for the materials they provide and the intended use. This includes relevant copyright, trademark, privacy, and likeness permissions.
Any use of identifiable people, confidential information, or restricted materials in AI tools must be discussed and agreed before processing.
Publication and accuracy
AI imagery may contain inaccuracies or visual inconsistencies. For commissioned work, the project agreement will set out the review and approval process.
Before publication, the parties must confirm responsibilities for product accuracy, factual claims, permissions, and any required AI disclosures or platform labels. These arrangements do not remove either party’s own legal obligations.
Availability and external links
We take reasonable care with this website but cannot guarantee uninterrupted access or that all information will always be current and error-free.
Links to external websites are provided for convenience. We do not control their content or privacy practices.
Nothing in these terms excludes liability that cannot lawfully be excluded or limits mandatory consumer rights.
Applicable law
These website terms are governed by Dutch law. Any mandatory protections available to consumers under applicable law remain unaffected.
Changes and contact
We may update this page to reflect changes to the website, our services, or legal requirements. The latest revision date appears above. Changes do not retrospectively alter an existing project agreement.
For privacy questions, usage permissions, or concerns about content appearing on this website, contact contact@studiopoiesis.ai.
